Overall aims and purpose

This module will discuss fundamental areas of employment and labour law including the employment relationship, contracts of employment, equality in employment, health and safety at work, termination of employment, Trade Union recognition, and employee collective action. Thereafter the module will address issues associated with globalization, harmonization, and the facilitation of a flexible Labour market. The initial focus will be on the law as developed in the UK but thereafter a comparative approach will be adopted with consideration of materials from European Union Member states, other common law jurisdictions, and China.

Course content

The history, development and regulation of the employment and labour law; The impact of European and Human Rights Law on development of employment and labour law; The employment relationship- distinguishing between employee and self- employed status; The contract and terms of employment.; Gender and Race Discrimination; Disability and Employment- a developing equality agenda; Health and Safety- common law and statutory provision and protection; Fair, Unfair, and Wrongful Dismissal; Trade Union recognition and the rights to collective action; TUPE; Employment and labour protection in other Commonwealth Countries; Employment and Labour protection in other EU and non-EU Countries.

Learning outcomes

  1. Demonstrate a critical understanding of the history, regulation of labour and the key UK institutions in facilitating employment rights.

  2. Critically discuss the principal issues from an individual and collective perspective.

  3. Research and discuss analytically the impact of both European and Human Rights legislation on the development of employment and labour law.

  4. Critically analyse legal and policy issues associated with the potentially conflicting demands of an equality agenda and the competing need for a flexible labour market;

  5. Explore the challenges associated with trying to satisfy the sometimes competing demands of equality, security and flexibility.

  6. Demonstrate an understanding of the application of the law to complex fact problems relating to both the recruitment and dismissal of employees;

  7. Critically evaluate and discuss comparative examples of employment and labour regulation from a choice of jurisdictions including common law Commonwealth countries, European and non-European jurisdictions.

  8. Formulate, investigate and refine suggestions for the development and/or reform of the existing law.

Teaching and Learning Strategy

Seminar

This module will consist of 11 x 2 hour seminars. Each seminar introduces students to the fundamental issues in a relevant area of employment and labour law and the application of those issues to areas of practical interest to employers and human resource managers. Other forms of teaching such as class presentations by students and guest presentations by practitioners may take place from time to time.
