Overall aims and purpose

Mae Cyfraith Datganoli yn fodiwl dewisol yn y rhaglen LLB. Nod y modiwl hwn yw galluogi myfyrwyr i gaffael ac arddangos gwybodaeth a dealltwriaeth gywir o ddatblygiad y gyfraith yng Nghymru ar ôl datganoli, ynghyd â chael golwg ehangach ar hanes datganoli yng Nghymru a mannau eraill yn Ewrop. Bydd yn eu galluogi i wneud asesiadau beirniadol o’r datblygiad a’r hanes hwnnw a chymharu a chyferbynnu’r datblygiad a’r hanes hwnnw yn gywir a pherthnasol gyda nodweddion unrhyw system gyfreithiol arall y mae’r myfyriwr yn gyfarwydd â hi. Yn olaf, bydd hefyd yn galluogi myfyrwyr i gysylltu’r datblygiad a’r hanes hwnnw â’r amgylchiadau neilltuol – gwleidyddol, cymdeithasol, economaidd – lle digwyddodd a lle mae’n parhau i ddigwydd.

Course content

Mae’r cwrs yn edrych ar gyfraith datganoli yng Nghymru a mannau eraill yn Ewrop. Astudir datblygiad hanesyddol datganoli yng Nghymru; o effaith Statud Rhuddlan 1284 a'r Deddfau Uno yn yr unfed ganrif ar bymtheg i ddatganoli grym yn raddol i adrannau a swyddfeydd Cymreig yn yr ugeinfed ganrif. Ceir astudiaeth fanwl o Ddeddf Llywodraeth Cymru a Mesur yr Iaith Gymraeg (Cymru), ynghyd â’r modd y mae darpariaethau’r ystatudau hynny’n cael eu gweithredu yng Nghymru ar ôl datganoli, a barn ysgolheigaidd yn ymwneud â hynny. O ganlyniad, rhoddir ystyriaeth i ddatblygiad Cyfansoddiad Cymreig ac ymddangosiad awdurdodaeth Gymreig. Bydd datblygiadau cyfreithiol a arweinir gan ddatganoli hefyd yn cael eu hystyried yng nghyd-destun y DU; gweinyddu cyfiawnder, yn arbennig cyfraith weinyddol; a datblygiad cysylltiadau rhyng-lywodraethol yn y DU ac Ewrop. Drwy gydol y cwrs, bydd y datblygiadau cyfreithiol yn ymwneud â newidiadau gwleidyddol, economaidd, cymdeithasol a deallusol yng Nghymru, y Deyrnas Unedig, Ewrop a’r byd ehangach. Yn arbennig, rhoddir sylw i’r setliad datganoli yn Yr Alban; Gogledd Iwerddon; Cymunedau Hunanreolaethol Sbaen; y Länder yn Yr Almaen.

Subject specific skills

  • Develop the ability to interpret legal rules and employ techniques of legal reasoning competently and efficiently in order to offer a range of solutions and conclusions to actual or hypothetical complex legal problems, all supported by relevant academic literature, jurisprudence and legislative research. Such solutions will be clearly communicated and presented
  • Develop the ability to analyse complex legal issues, set against the background of the political, social, economic or cultural contexts in which they may arise
  • Develop those skills which are necessary for scholarship and research in legal subjects, namely the ability to identify relevant primary and secondary legal sources and to retrieve accurate legal information using paper and electronic sources
