Overall aims and purpose

Nod y modiwl yw galluogi myfyrwyr i ddysgu a dangos gwybodaeth a dealltwriaeth gywir o ddatblygiad y gyfraith yng Nghymru ar ôl datganoli, ynghyd â throsolwg ar hanes datganoli yng Nghymru ac mewn rhannau eraill o Ewrop. Bydd yn galluogi myfyrwyr i asesu’r datblygiad a’r hanes hwnnw yn feirniadol a chymharu a gwrthgyferbynnu'r datblygiad a’r hanes hwnnw yn gywir ac yn berthnasol gyda systemau cyfreithiol eraill y mae’r myfyriwr yn gyfarwydd â hwy.

Course content

Mae’r cwrs yn edrych ar gyfraith datganoli yng Nghymru ac mewn rhannau eraill o Ewrop. Caiff datblygiad hanesyddol datganoli yng Nghymru ei astudio; yn cynnwys effaith Statud Rhuddlan 1284, Deddfau Uno’r unfed ganrif ar bymtheg a’r broses raddol o ddatganoli grym i adrannau a swyddfeydd yng Nghymru yn yr ugeinfed ganrif. Ceir hefyd astudiaeth fanwl o Ddeddfau Llywodraeth Cymru a Mesur y Gymraeg (Cymru), ynghyd â’r modd y mae darpariaethau’r statudau hynny’n cael eu gweithredu yng Nghymru ar ôl y datganoli, a barn ysgolheigaidd yn ymwneud â hynny. O ganlyniad, rhoddir ystyriaeth i ddatblygiad cyfansoddiad Cymru ac ymddangosiad awdurdodaeth Cymru. Caiff datblygiadau cyfreithiol a ysgogwyd gan ddatganoli hefyd eu hystyried yng nghyd-destun y DU; gweinyddu cyfiawnder, yn benodol cyfraith weinyddol; a datblygiad cysylltiadau rhynglywodraethol yn y DU ac yn Ewrop. Drwy gydol y cwrs, bydd y datblygiadau cyfreithiol yn ymwneud â newidiadau gwleidyddol, economaidd, cymdeithasol a deallusol yng Nghymru, y Deyrnas Unedig, Ewrop a’r byd ehangach. Rhoddir sylw arbennig i’r setliad datganoli yn yr Alban, Gogledd Iwerddon, Cymunedau Ymreolaethol Sbaen; a Länder yr Almaen.

Assessment Criteria

threshold

D- hyd at D+ (40-49%) Trothwy: Bydd myfyrwyr (D- hyd at D+) yn dangos sgiliau ymchwil boddhaol mewn rhannau o leiaf o'r pwnc a ddewiswyd ganddynt, a byddant yn gwneud ymdrechion rhannol lwyddiannus o leiaf i archwilio a dadansoddi'r wybodaeth ac i ysgrifennu'r project mewn dull academaidd.

Ateb sy'n gywir gan fwyaf o ran cyflwyno deunydd, ond sy’n cynnwys lefel sylweddol o wallau, ac felly nid yw’n hollol ddibynadwy.

excellent

A- hyd at A (70%+) Rhagorol: Bydd myfyrwyr rhagorol (A- hyd at A*) yn cyflawni'n gyson gadarn ar draws y deilliannau dysgu, ac yn cyfuno hyn â gwreiddioldeb, gwybodaeth eang o'r pwnc yn ei gyd-destun ehangach ynghyd â dadleuon a dadansoddiad treiddgar a soffistigedig.

Ateb rhagorol, sy’n dangos meistrolaeth dros y pwnc dan sylw heb fawr ddim lle o gwbl i wella. Mae’r ateb yn cynnwys yr holl bwyntiau a dadleuon perthnasol, ynghyd â gwerthusiad llawn annibynnol ac aeddfed o’r testun, heb fawr ddim camgymeriadau neu gynnwys amherthnasol. Lle bo’n berthnasol, bydd yr ateb hefyd yn dangos tystiolaeth o werthusiad cymharol manwl o’r materion dan sylw. Bydd yr holl ddeunydd a chyfeiriadau (lle bo’n berthnasol) wedi’u cyflwyno bron yn berffaith yn yr ateb, a bydd yr ateb wedi’i lunio’n hynod dda ac yn rhagorol yn ramadegol yn Gymraeg/Saesneg.

good

B- hyd at B+ (60-69%) Da: Bydd myfyrwyr da (B- hyd at B+) yn llwyddo'n gadarn yn yr holl ddeilliannau dysgu a restrir.

Ateb cynhwysfawr, yn cynnwys yr holl neu bron y cyfan o’r deunydd sy’n berthnasol i’r cwestiwn a dim amherthnasedd, neu ychydig iawn; yr holl ddeunydd a’r cyfeiriadau yn gywir at ei gilydd, heb ddim anghywirdeb na gwallau, gan gyflwyno’r cyfan mewn dadl glir, resymegol a beirniadol, ond sydd â lle i wella ei adeiladwaith a’i gyflwyniad. Ateb sy’n dangos hyfedredd llwyr yn y pwnc.

C- to C+

C- i C+ (50-59%) Da/Boddhaol: Bydd myfyrwyr lefel C- i C+ yn llwyddo'n ddisgrifiadol yn yr holl ddeilliannau dysgu a restrir.

Ateb sydd, er ei fod bob amser yn gywir gan fwyaf, serch hynny yn methu â gwahaniaethu rhwng deunydd perthnasol ac amherthnasol, ac sydd â diffyg beirniadaeth. Ateb sy’n ddibynadwy o ran cywirdeb, ond nad yw’n gynhwysfawr neu nad yw’n hollol berthnasol.

Learning outcomes

  2. Disgrifio’n gywir, dadansoddi, cymharu a sylwebu ar ddatblygiad sefydliadau a meysydd y gyfraith yng nghenhedloedd a rhanbarthau datganoledig y DU ac Ewrop, gan eu perthnasu i’w hachosion a’u heffeithiau gwleidyddol, cymdeithasol, economaidd a deallusol.

  3. Bod yn ymwybodol o’r cyd-destun ehangach mewn yng nghyswllt gweithredu cyfraith datganoli yng Nghymru, e.e. y berthynas rhwng Llywodraeth Cymru â'r llywodraeth ganolog yn Whitehall.
