Overall aims and purpose

Mae'r modiwl yma'n fodiwl opsiynol ar y gradd LLB. Nod y modiwl yma yw galluogi myfyrwyr i ddysgu a dangos gwybodaeth a dealltwriaeth gywir o sut mae corff o gyfraith Cymreig wedi datblygu mewn ffordd gwahanol i'r gyfraith yn Lloegr, fel canlyniad o ddatganoli. Bydd yn galluogi myfyrwyr i adnabod gwahaniaethau pwysig yn y gyfraith, ac i asesu'r datblygiadau a'r gwahaniaethau hynny'n feirniadol.

Er nid yw'n angenrheidiol astudio modiwl Datganoli ynghyd a'r modiwl yma, mae'r naill modiwl yn gymhares i'r llall.

Course content

Mae'r modiwl yn edrych yn benodol ar sut mae cyfraith yng Nghymru wedi datblygu'n wahanol i'r gyfraith yn Loegr, a hynny oherwydd datganoli. Nid yw Cymru'n awdurdodaeth cyfreithiol ar wahan i Loegr ar hyn o bryd, oherwydd bod y farnwriaeth a'r llysoedd yn dilyn cyfraith Cymru a Lloegr a wneir gan Senedd y Deyrnas Unedig, ac felly nid yw'n benodol i Gymru; ond, mae yna gorff o gyfraith Cymreig sydd yn tyfu yn sydyn iawn. Gall hyn beri dryswch wrth geisio canfod lle mae'r gwahaniaethau yn y gyfraith, a pha gyfraith dylid gyfeirio ato mewn sefyllfa penodol. Felly, mae'n hynod bwysig bod gan unrhyw un sy'n ymwneud a'r gyfraith yng Nghymru a Lloegr ddealltwriaeth llawn o'r gwahaniaethau pwysig yma

Caiff trosolwg bras o ddatganoli i gychwyn, er mwyn gwerthfawrogi'r cyd-destun ehangach, ynghyd ag esboniad o sut y caiff cyfraith ei greu yng Nghymru. Ceir hefyd astudiaeth fanwl a thrafodaeth difyr o'r meysydd cyfraith lle mae gwahaniaethau sylweddol rhwng Cymru a Lloegr, megis addysg, iechyg a chyfiawnder gweinyddol. Bydd cyfle hefyd i edrych yn feirniadol ar adroddiad Y Comisiwn ar Gyfiawnder yng Nghymru (2019), ag edrychodd ar datganoli'r system cyfiawnder yn llawn yng Nghymru.

Learning outcomes

  1. Ffurfio dehongliadau a dadleuon gwreiddiol ar bynciau'n ymwneud a gyfraith Cymreig, yn cynnwys creu cysylltiadau newydd rhwng pynciau perthnasol.

    Formulate original interpretations and arguments on topics relating to Welsh law, including creating new links between relevant topics.

  2. Canfod, cyfosod a dadansoddi'n feirniadol ffynhonellau cyfreithiol perthnasol wrth gynnal ymchwil annibynnol ar gyfraith Cymreig.

    Identify, synthesise and critically analyse relevant legal resources while conducting independent research on Welsh law.

  3. Cyfathrebu ac esbonio dadleuon rhesymegol yn gryno ac yn effeithiol, yn ysgrifenedig mewn arholiad.

    Communicate and explain reasoned arguments succinctly and effectively, in writing in an examination.

  4. Dangos dealltwriaeth gynhwysfawr o ddatblygiadau diweddar mewn cyfraith Cymreig a'r tirwedd gwleidyddol ehangach, yn cynnwys y gallu i bwyso a mesur y gwahaniaethau rhwng y gyfraith yng Nghymru a'r gyfraith yn Loegr.

    Demonstrate comprehensive understanding of recent developments in Welsh law and the wider political landscape, including the ability to evaluate the differences between the law in Wales and the law in England.

  5. Dangos lefel uchel o fedrusrwydd wrth ddatblygu, strwythuro a mynegi dadleuon perthnasol yn ymwneud â materion yng nghyfraith Cymru.

    Demonstrate a high level of skill in developing, structuring and articulating relevant arguments in relation to matters of Welsh law.

Subject specific skills

  • Develop the ability to interpret legal rules and employ techniques of legal reasoning competently and efficiently in order to offer a range of solutions and conclusions to actual or hypothetical complex legal problems, all supported by relevant academic literature, jurisprudence and legislative research. Such solutions will be clearly communicated and presented
  • Develop the ability to analyse complex legal issues, set against the background of the political, social, economic or cultural contexts in which they may arise
  • Develop those skills which are necessary for scholarship and research in legal subjects, namely the ability to identify relevant primary and secondary legal sources and to retrieve accurate legal information using paper and electronic sources
