Overall aims and purpose

Modiwl opsiynol yn y rhaglen LLB yw Cyfraith Datganoli. Nod y modiwl yw galluogi myfyrwyr i ddysgu a dangos gwybodaeth a dealltwriaeth gywir o ddatblygiad y gyfraith yng Nghymru ar ôl datganoli, ynghyd â throsolwg ar hanes datganoli yng Nghymru ac mewn rhannau eraill o Ewrop. Bydd yn galluogi myfyrwyr i asesu’r datblygiad a’r hanes hwnnw yn feirniadol a chymharu a gwrthgyferbynnu'r datblygiad a’r hanes hwnnw yn gywir ac yn berthnasol gyda systemau cyfreithiol eraill y mae’r myfyriwr yn gyfarwydd â hwy.

Course content

Mae’r cwrs yn edrych ar gyfraith datganoli yng Nghymru ac mewn rhannau eraill o Ewrop. Caiff datblygiad hanesyddol datganoli yng Nghymru ei astudio; yn cynnwys effaith Statud Rhuddlan 1284, Deddfau Uno’r unfed ganrif ar bymtheg a’r broses raddol o ddatganoli grym i adrannau a swyddfeydd yng Nghymru yn yr ugeinfed ganrif. Ceir hefyd astudiaeth fanwl o Ddeddfau Llywodraeth Cymru a Mesur y Gymraeg (Cymru), ynghyd â’r modd y mae darpariaethau’r statudau hynny’n cael eu gweithredu yng Nghymru ar ôl y datganoli, a barn ysgolheigaidd yn ymwneud â hynny. O ganlyniad, rhoddir ystyriaeth i ddatblygiad cyfansoddiad Cymru ac ymddangosiad awdurdodaeth Cymru. Caiff datblygiadau cyfreithiol a ysgogwyd gan ddatganoli hefyd eu hystyried yng nghyd-destun y DU; gweinyddu cyfiawnder, yn benodol cyfraith weinyddol; a datblygiad cysylltiadau rhynglywodraethol yn y DU ac yn Ewrop. Drwy gydol y cwrs, bydd y datblygiadau cyfreithiol yn ymwneud â newidiadau gwleidyddol, economaidd, cymdeithasol a deallusol yng Nghymru, y Deyrnas Unedig, Ewrop a’r byd ehangach. Rhoddir sylw arbennig i’r setliad datganoli yn yr Alban, Gogledd Iwerddon, Cymunedau Ymreolaethol Sbaen; a Länder yr Almaen.

  1. Disgrifio’n gywir, dadansoddi a sylwebu ar ddatblygiad sefydliadau a meysydd y gyfraith yng Nghymru ar ôl datganoli trwy gyfeirio at ffynonellau gwreiddiol a ffynonellau eilaidd priodol, gan berthnasu’r datblygiad i’w achosion a’i effeithiau gwleidyddol, cymdeithasol, economaidd a deallusol.

  2. Disgrifio’n gywir, dadansoddi, cymharu a sylwebu ar ddatblygiad sefydliadau a meysydd y gyfraith yng nghenhedloedd a rhanbarthau datganoledig y DU ac Ewrop, gan eu perthnasu i’w hachosion a’u heffeithiau gwleidyddol, cymdeithasol, economaidd a deallusol.

  3. Canfod, nodi a defnyddio ffynhonellau disgrifiadau cyfreithiol perthnasol yng nghyswllt cyfraith datganoli yng Nghymru ac mewn rhannau eraill o Ewrop.

  6. Trosglwyddo’r wybodaeth yn 3 a 4 yn effeithiol, ar lafar mewn seminarau ac yn ysgrifenedig mewn asesiadau ffurfiannol a chrynodol.

  7. Gwneud ymchwil cyfreithiol annibynnol yng nghyswllt cyfraith datganoli yng Nghymru ac mewn rhannau eraill o Ewrop.

Subject specific skills

  • Develop the ability to interpret legal rules and employ techniques of legal reasoning competently and efficiently in order to offer a range of solutions and conclusions to actual or hypothetical complex legal problems, all supported by relevant academic literature, jurisprudence and legislative research. Such solutions will be clearly communicated and presented
  • Develop the ability to analyse complex legal issues, set against the background of the political, social, economic or cultural contexts in which they may arise
  • Develop those skills which are necessary for scholarship and research in legal subjects, namely the ability to identify relevant primary and secondary legal sources and to retrieve accurate legal information using paper and electronic sources
